PUBLIC OFFER
This User Agreement (hereinafter referred to as the "Agreement") is entered into by and between LLP "PREMIUM BEAUTY", registered office: 050059, Republic of Kazakhstan, Samal-2 microdistrict, building 67 (hereinafter referred to as the "Website Administration"), on the one part, and the User (individuals and legal entities – citizens of the Republic of Kazakhstan or foreign citizens), being any person intending to use and/or using the website www.cdv.kz (hereinafter referred to as the "Website"), on the other part.
This Agreement defines the terms, restrictions, and guarantees for the use of the Website.
1. Terms and Definitions
Offer — a public offer by the Website Administration addressed to any individual or legal entity to conclude a contract of sale or another contract under the terms set forth herein and in all annexes hereto.
Website Administration — the legal entity LLP "PREMIUM BEAUTY", registered at 050059, Republic of Kazakhstan, Almaty, Samal-2 microdistrict, building 67, incorporated under the laws of the Republic of Kazakhstan, engaged in the sale of Goods, including distance sales.
User — an individual or legal entity that has entered into an Agreement with the Website Administration under the terms of this Agreement.
Acceptance — full and unconditional acceptance by the User of the terms of this Agreement.
Goods — the range of items presented on the Website www.cdv.kz.
Website — a set of electronic documents (files) belonging to the Website Administration, available on the Internet at www.cdv.kz.
2. General Provisions
2.1. This Agreement is a public offer.
2.2. By using the Website, the User confirms their full and unconditional acceptance of this Agreement.
2.3. The Website Administration has the right to amend this Agreement unilaterally. Amendments shall enter into force from the moment they are published on the Website unless otherwise specified.
3. Subject of the Agreement
3.1. The Website Administration provides the User with access to the Website and the possibility to purchase Goods remotely.
3.2. The Website is intended for providing information about Goods and placing Orders.
4. Rights and Obligations of the Parties
4.1. The User shall:
provide accurate and complete information when placing an Order;
comply with the terms of this Agreement and applicable laws;
not use the Website for unlawful purposes.
4.2. The Website Administration shall:
provide the User with access to the Website;
process Orders in accordance with the rules established herein;
ensure confidentiality of the User’s personal data in accordance with the legislation of the Republic of Kazakhstan.
5. Liability of the Parties
5.1. The Website Administration shall not be liable for any damages resulting from improper use of the Website by the User.
5.2. The Website Administration shall not be responsible for interruptions in the operation of the Website due to technical failures, maintenance, or actions of third parties.
5.3. The User is responsible for the accuracy of the information provided by them when placing an Order.
6. Confidentiality
6.1. The Website Administration guarantees the confidentiality of personal data provided by the User.
6.2. The Website Administration processes personal data in accordance with the Law of the Republic of Kazakhstan "On Personal Data and Their Protection".
7. Limitation of Liability
7.1. The Website Administration shall not be liable for indirect damages, including lost profit, arising from the use of the Website.
7.2. The Website Administration does not guarantee uninterrupted or error-free operation of the Website.
8. Validity, Amendment, and Termination of the Agreement
8.1. This Agreement enters into force from the moment of the User’s Acceptance.
8.2. The Agreement shall remain in force until terminated by either Party.
8.3. The User may terminate this Agreement by ceasing to use the Website.
9. Final Provisions
9.1. This Agreement is governed by the laws of the Republic of Kazakhstan.
9.2. All disputes arising out of this Agreement shall be resolved in accordance with the legislation of the Republic of Kazakhstan.
